(1) Services
123 Creative offers creative services including but not limited to graphic design, branding, digital illustration, and web design. Our services are subject to availability and project scope. We reserve the right to modify, suspend, or discontinue any aspect of our services without prior notice.
(2) Client Responsibilities
When using our services, you agree to:
Provide accurate and complete information for project requirements
Cooperate and provide timely feedback during the design process
Respect intellectual property rights and not submit copyrighted material without authorisation
(3) Communication
We strive to maintain effective communication with our clients. Communication methods include emails, phone calls, virtual meetings, coffee catch-ups and other mutually agreed-upon channels. We are not responsible for any consequences arising from miscommunication due to inaccurate contact details or technical issues.
(4) Pricing and Payment
Project pricing and payment terms will be outlined in the project proposal or agreement. Unless otherwise stated, a non-refundable deposit is required before work commences. Full payment is due upon completion of the project or as specified in the agreement.
(5) Intellectual Property
Upon project completion and full payment, you will have ownership of the final design files. Until full payment is received, 123 Creative retains ownership of all preliminary designs and concepts. We reserve the right to showcase completed projects in our portfolio or promotional materials.
(6) Confidentiality
We respect your confidentiality and will not disclose sensitive information shared during the project.
(7) Refinements and Changes
We offer a specific number (3) of refinements as agreed upon in the project proposal. Additional refinements or major changes outside the scope of the original agreement may incur extra charges. Changes requested after project approval may also result in additional fees.
(8) Termination
Either party has the right to terminate a project if there is a breach of the agreement or if circumstances prevent the project from continuing. In the event of termination, you agree to compensate us for the work completed up to that point.
(9) Limitation of Liability
123 Creative is not liable for any direct, indirect, special, incidental, or consequential damages arising out of the use or inability to use our services, even if advised of the possibility of such damages.
(10) Modifications
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be effective upon posting on our website. By continuing to use our services after changes have been made, you agree to be bound by the revised terms.
